BULAWAYO - A Senior prison officer is languishing in remand prison after a Bulawayo magistrate denied him bail saying he will interfere with investigations and state witnesses.
Phillip Muleya who is based at Grey Prison in Bulawayo is facing charges of incitement to commit the offence of theft had his application for release on bail dismissed by the court last Friday. Denying Muleya bail the court said the prison officer was likely to interfere with investigations. The court ruled: “After considering the submissions, accused is not a suitable candidate for bail. He is likely to interfere with State witnesses since investigations are still under way. “Looking at the position accused holds in the employment sector, the likelihood to abscond if granted bail is high due to the fact that his job description is aggravating to the offences he is alleged to have committed." According to the state charges against Muleya are that on 25 January he approached an ex-convict Hardlife Nkomo with a proposal to steal from a Bulawayo company. It is alleged that Muleya asked Nkomo if he was courageous enough to steal from a certain company in Belmont industrial area, which keeps lot of cash. The senior prison officer’s plan was that he would organise some firearms with some unidentified police officers and they would proceed to the company. Muleya made arrangements with Nkomo to meet on the following day so that they could go and commit the offence. However, the information was leaked to the police and he was arrested before the commission of the offence. ?The prison officer also facing another charge of criminal abuse of office after he allegedly entered into an agreement with relatives of two men in remand prison to facilitate their release on bail. He was paid US$200 by the relatives but he was arrested before facilitating the two men’s release from prison. |
