The postponement is to allow the respondents, who are opposed to the company being liquidated, to pay off those who are no longer interested.
The respondents in the application are board members of the company: Moffat Marasha, Fibion Kariweni, Peter Matambo, Luis Masuka, a Z Mbiko and Prisca Masungo.
Andrew Ndlovu and others approached the High Court through their lawyer, Lawrence Chikwakwa, and applied for the company to be placed under liquidation.
On December 4, 2009, the High Court placed the company under provisional liquidation and Victor Muzenda was appointed the provisional liquidator.
On January 7 last year, the Provisional Order was extended to February 4 the same year. The board of directors filed a Notice of Opposition to the winding up of the company arguing that Ndlovu, one of the applicants, has no right to file the application since he is not a member.
